1. Session & Parties
This Photography Services Agreement ("Agreement") is entered into between Rodney Gilcreast Jr., doing business as Rodney Jr Productions ("Photographer"), and the client submitting this booking request ("Client"), for the session type, date, and location specified above.
2. Payment & Deposit
- A deposit equal to 20% of the total session fee is required to hold and confirm the Client's date. The session is not considered booked until this deposit is received.
- The deposit is final and non-refundable once paid.
- The remaining balance is due on the day of the session, before or at the start of shooting, unless otherwise agreed in writing.
- Accepted payment methods: Venmo, CashApp, PayPal, and Zelle.
3. Cancellation & Rescheduling
- Deposits are non-refundable under any circumstance, including cancellation by the Client.
- Clients may reschedule their session one time at no additional charge, provided at least 7 days' notice is given before the original session date. The deposit will transfer to the new date.
- Reschedule requests made with less than 7 days' notice, or additional reschedules beyond the first, may require a new deposit at the Photographer's discretion.
- If the Photographer must cancel or reschedule due to illness, emergency, or conditions outlined in Section 9 (Force Majeure), the Client will be offered a new date with the original deposit applied, or a full refund of the deposit.
- No-shows without notice forfeit the deposit and any balance paid, and are not entitled to a rescheduled session.
4. Image Usage & Copyright
- The Photographer retains full copyright ownership of all images produced during the session.
- The Client receives a personal-use license to download, print, and share the delivered images.
- The Photographer may use session images for portfolio, marketing, social media, and promotional purposes unless the Client requests otherwise in writing prior to the session.
- Images may not be sold, used commercially, or altered by the Client without the Photographer's written permission.
5. Model Release
By signing below, the Client (and any individuals the Client is authorized to represent, such as minors in their care) grants the Photographer permission to photograph them and use those images as described in Section 4.
6. Delivery Timeline
Edited galleries are typically delivered within 2 days to 2 weeks of the session date, depending on session type and complexity, and will be shared through a private online gallery link.
7. Liability
- The Photographer will make every reasonable effort to capture and deliver high-quality images but is not liable for circumstances beyond reasonable control, including equipment failure, weather, venue restrictions, or acts of third parties.
- In the unlikely event that images are lost or unusable due to circumstances within the Photographer's control, the Photographer's liability is limited to a refund of fees paid for the affected session.
8. Travel
The Photographer primarily serves the East Texas region and the Tucson, Arizona area. Sessions outside these regions may require an additional travel fee, to be discussed and agreed upon before booking.
9. Force Majeure
Neither party is liable for delay or failure to perform due to events beyond reasonable control, including but not limited to severe weather, natural disaster, illness, or emergency. In such cases, the session will be rescheduled per Section 3.
10. Entire Agreement
This Agreement, combined with the session details submitted in this booking form, represents the full understanding between Photographer and Client for this session. By typing your name below and submitting this form, you acknowledge that you have read, understood, and agree to these terms.
